hi everyone
I m an MBA(major:general mba)student in a university in texas. I have an bachelors of engineeing (electrical & electronics)from india. I have found an desi employer who is ready to train me in SAP (FICO)functional and than place me on projects to diffeent companies. Since i m graduating in august 2008 ,At first i have to work for him on OPT and than in apil 2009 my employer will sponcer my h1 visa.
Now my question is....
1) can i work in SAP FICO functional , when i m on my opt?(opt means i have to work in a job directly related to my major field of study and i guess SAP is not related to my field major field of study)
2)will i have problems getting a h1b visa? (since General MBA and SAP are completely different fields )
Any comments or suggestions will be appreciated.

I have no US visa stamped in my passport and planning to fly Emirates to India via Dubai. I will use AP for re-entry. Do I need transit visa at Dubai like London and other European Airports? Response from anyone with experience will be appreciated. If already discussed here, guidance to particular forum will help.
I have traveled by Emirates several times (last year was the recent one) and they did NOT require a transit visa.

I have one question?
What if my employer cancels I140 and I don't have any other job on my hand? This can be a possibility for me in near future. I am searching for a new job and my employer is going to cancel I140.
Is it good to wait for any RFE or denial and if it occurs, just sending them new EVL of any consulting firm (with or without project) will help?

I shot this with my old dig camera - a Sony F707
The colour is pretty much unaltered. I cleaned up a few stray reflections in the water and tried to lighten the eyes of the loons a bit. I would be intested in any criticism at all.

And its official now.. USCIS have consolidated on one more conniving trend to continue to keep us in the dark :mad:
The dates are claimed to be "as of " Aug 31st.
When they did this in the last update and said the dates were "as of " July 31 2008, I thought it was going to be a one time thing and in the next update they will give us up to the date info. But hell NO!!
If they only disclose info as of some date in the past, how the hell are we supposed to know whether our case is currently "beyond" normal processing times !!! And how the heck can we file a service request !
They just want us off their back altogether and go at their own pace.
With this staggered (Processing dates and PD) approach, they can manipulate one thing or the other (Spike the PD and retrogress the Proc Date OR vice Versa) and forever juggle and skirt around accountability altogether and don't have to answer or take any status queries at all ! Why don't they use the same intelligence to try to improve their processes and improve their productivity !

I am not sure if this situation below has been faced by any forum member. Would appreciate any information/experience or advise from fellow members and attorneys
I am on H1-B - I- 140 approved stage (EB3) for past several years and have faced no issue with Extensions(5) and 8 Stampings over this long period, working for the same employer.Apr 2003 PD with 1 yr left on current H1 extension.
I 485- AOS not applied
I am now contemplating to return permanently due to personal reasons and in this process effectively abandon the H1-B and GC process.
After I return, my employer would keep the I-140 and GC process active and I may work for the same employer remotely.
What are the options I have ?
1.If I do not apply for the H1-B extension next year but my employer keeps the job open for the next few years(future employ), is Consular Processing possible once Apr-03 becomes current- say 3 years from now.. - what documents would I require in that case?
In the next 4 years, possibly Eb3 April 03 might become available thus making the AOS possible thru Consular Processing

I had a RFE against my I-485 in last week of Nov 07. It was for medical exam, doc forgot to check one box :(
Now the RFE has been replied to and USCIS should hopefully have no further questions on my application. But now the issue is retrogression of EB2 India back to Jan 02 (while I am Jun 03). So does that mean though my application could be cleared by the immigration officer, it will still be put back on shelf because of the retrogression in Dec 07 ?

this is my understanding but a lawyer answer but you should consult a lawyer
Since you have started your GC process and shown your intent to immigrate your F1 will be denied.
H1 is a dual intent visa ( you enter as non immigrant but U can immigrate on it) and hence application of GC has no implication on it.
Again I am not a lawyer so consult one.
